COMPETITION LIABILITY WAIVER - AGREEMENT TO PARTICIPATE AND MEDICAL RELEASE WAIVER AND CONSENT
SECTION I - RELEASE OF LIABILITY AND AGREEMENT TO PARTICIPATE
In consideration of being permitted to participate in any way, including travel to and from, AM-CAN INTERNATIONAL JUDO CHALLENGE, INC., (the "Competition") and related events and activities of United States Judo, Inc., United States Judo Federation, United States Judo Association, New York State Judo, Inc., Canisius College of Buffalo, New York, I hereby:
1. Acknowledge that I am familiar with the sport of Judo and understand the rules governing the sport of Judo.
2. Agree that, prior to participating, I will inspect the mats, equipment, facilities, competition pools or divisions, and the elimination or scoring system to be used, and if I believe anything is unsafe or beyond my capability, I will immediately advise my coach supervisor and/or a tournament official of such conditions and refuse to participate.
3. Acknowledge and fully understand that I will be engaging in a contact sport that might result in serious injury, including permanent disability or death, and severe social and economic losses due not only to my own actions, inactions or neglect, but also to the actions, inactions, or negligence of others, the rules of the sport of Judo, or conditions of the premises or of any equipment used. Further I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time.
4. Knowing the risks involved in the sport of Judo, I voluntarily elect or accept and solely assume all such risks and accept personal responsibility for all damages, injury, including death, incurred or suffered by me (a) while practicing or playing the sport of Judo and in my participation in the Competition (b) while serving in a non-playing capacity as an observer during practice or play by other players, and (c) while on or upon the premise of at which the Competition and all practice sessions are or may be conducted for practice or play.
5. Release, waive, discharge and covenant not to sue the United States Judo, Inc., United States Judo Federation, United States Judo Association, New York State Judo, Inc., AM-CAN International Judo Challenge, Inc., and Canisius College of Buffalo, New York together with their affiliated clubs, their respective officers, administrators, directors, agents, coaches, and other employees or volunteers of the organization, event officials, medical personnel, other participants, their parents, guardians, supervisors and coaches, sponsoring agencies, sponsors, advertisers, and if applicable, owners, lessors and lessees of premises used in conducting the event, all of whom are hereinafter referred to as “releasee”, from any and all claims, demands, losses, costs, causes of action or damages sustained or incurred by me including permanent disability and death or damage to property, from whatever cause, including but not limited to, the negligence, breach of contract or wrongful conduct of the parties hereby released.
FOR PARENTS/GUARDIANS OF PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT TIME OF REGISTRATION)
This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release, as provided above, of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s involvement or participation in these programs as provided above, even if arising from their negligence, to the fullest extent permitted by law. I have instructed the minor participant as to the above warnings and conditions and their ramifications.
SECTION II - PARTICIPATION APPROVAL FOR NON-BLACK BELT CONTESTANTS
By checking the electronic signature box I certify that the participant’s Judo Instructor, who has been awarded the Judo rank of Shodan or higher, recognized by a National Governing Body of Judo, has certified that the participant is of sufficient aptitude and skill in Judo to compete in this event and division, although the participant HAS NOT been awarded the rank of Shodan or higher. I furthermore agree to provide a copy of the participants proof of rank (rank certificate, USA Judo, USJA, USJF membership card having the verification symbol "(V)" at the time of registration and weigh-ins for the tournament.
SECTION III - MEDICAL RELEASE WAIVER AND CONSENT
I understand that if my child is injured or becomes ill, or is even suspected of injury or illness during the tournament, including travel to and from and preparation for or activities associated with the tournament, certain medical decisions may have to be made for my minor child. These may include decisions regarding medical assessment, treatment, care and transport or transfer to a medical facility. In the event that I am not present at the tournament site and available if and when such a circumstance occurs, I hereby designate and authorize the person(s) indicated in this on-line registration to make evaluations, judgments and decisions regarding my child’s medical care:
I understand that these decisions may include determinations to accept, delay or decline medical treatment, care and/or transport, including to accept or refuse medical attention and to sign any documents on my child’s behalf in connection therewith. I specifically authorize the above-named persons to make decisions in my place and stead to accept, delay or decline medical treatment, care and/or transport for my child, to the fullest extent permitted by law. I further warrant that I have discussed my child’s pertinent medical history with the above-named persons, and that they have been made aware of any pre-existing injuries, medical conditions, medications and/or allergies which my child may have. If possible, I have provided this information in written form for the above person(s) to bring to the tournament. My designee(s) is/are specifically authorized to disclose to tournament and medical personnel any information relevant to the care, treatment and medical decision-making regarding my child.
I hereby release, waive and agree, for myself, my minor child and all of our family, heirs, assigns and next of kin that I will hold harmless the tournament organizers, all medical personnel, including emergency medical personnel and first responders, my designee(s), and all other persons associated with this tournament and any related activities for any and all liabilities incident to my minor child’s participation as provided above and within, including, but not limited to any and all treatment, care, decisions, including decisions to consent to or decline treatment, care or transport, judgments, actions, inactions or failures to act related to my minor child, to the fullest extent permitted by law. I have instructed the minor participant as to the above instructions, warnings and conditions and their ramifications.
